“Protect your agency’s IP in your pitch or proposal,” cautioned attorney Sharon Toerek, in her two workshops for CAPRSA. “Don’t sign an NDA if it isn’t mutual or if it doesn’t create ownership in the agency’s IP automatically.”
Toerek, principal owner at Legal+Creative law firm and monthly columnist in The Agency 100, urged agencies to include IP ownership clauses in their proposals or pitch decks, “using copyright law to your advantage.”
